Can Governor Ademola Adeleke be Disqualified Before 2026 Guber Election?
Cross session of the masses which belong to the opposition party within Osun State are with the opinion that he (Governor Ademola Adeleke) would be disqualified before August 8th, 2026 because he purchased nomination forms from two different political parties.
Already, they are jubilating as they thought they have gotten a lacuna where they can use against him. The analysis is that, masses will have no option when Governor Ademola Adeleke is disqualified than to vote for the opposition.
Part of what they were citing is that "The spirit of the law forbids anyone to contest for nomination under two or more political parties in same election or even start the process of being nominated by procuring the nomination form." Supreme Court, on Nwosu Vs Uzodimma, June 2020.
What does the constitution say about purchasing two nomination forms from two different political parties for the same election? According to Adam Osgwe SAN, Section 115 of the electoral act, 2022 says; an aspirant who lost primary election in party 'A' can pick up expression of interest form in party 'B' or 'C' in event of the death or withdrawal of the candidate in that party.
Only a person who emerged a candidate of a political party through valid primaries monitored by INEC and has signed the nomination form prescribed by INEC that cannot be a candidate for another position in the same political party or another. That provision only applies to 'Candidates' not 'Aspirants.'
In the case of Governor Ademola Adeleke, he only purchased nomination form from the People's Democratic Party, he resigned three days after and never participated in their primaries. He never became PDP governorship candidate, he stopped at the level of aspirant. There is no way this can be applied to him.
He only participated in Accord party primary election monitored by INEC and signed nomination form prescribed by INEC which made him bonafide governorship candidate for the party.
Before the electoral law and Nigeria constitution, Governor Ademola Adeleke has done nothing wrong to have contest under Accord party.
